1. The elements of distress are the threat of death or serious bodily harm that causes an individual to commit a crime. The threat must be imminent and immediate for the person to be compelled to commit a crime involuntary. A person must have exhausted all reasonable and available alternatives to violating the law. Lastly the element of duress states a person must not create or assist in creating circumstances leading to the claim of duress. 2. The four major approaches to the legal insanity approach are M’Naghten test, irresistible impulse, Durham product test and American Law Institute/ Model Penal Code.
